Welcome to Webcrafts.in. Please read these Terms and Conditions carefully before using our website design, web development, mobile app development, and digital marketing services. By using our services, you agree to comply with and be bound by these Terms and Conditions and our Privacy Policy.
- Description of Services
Webcrafts offers professional services including, but not limited to, website design and development, e-commerce solutions, mobile application development, content creation, search engine optimization (SEO), digital marketing, maintenance, and support services. Any new features or enhancements to current services are subject to these Terms and Conditions.
Webcrafts reserves the right to amend, suspend, or discontinue services without prior notice due to non-cooperation, non-payment, or client-caused delays. Webcrafts and its suppliers are not liable for losses or damages arising from such actions.
- Acceptance
You are not required to sign these Terms for them to be binding. By accepting a quote, making an advance payment, or using our services, you indicate your full acceptance of these Terms & Conditions. - Software, Database, & Application Development
Webcrafts takes all reasonable measures to deliver secure, error-free products; however, the client must independently verify that all projects function correctly before use. Webcrafts is not liable for loss due to malfunction in any delivered software.
If projects are hosted on third-party servers, the client is responsible for providing required information, server access, and software. Clients developing large applications must provide a test environment identical to their production environment.
Clients are encouraged to fully test deliverables before launch. Webcrafts may, at its discretion, address post-launch issues but is not obligated to provide unlimited fixes.
- Pricing and Payments
Service charges are specified in the official project quotation, valid for 30 days unless otherwise agreed. If the quote expires, Webcrafts may alter or decline it.
Unless otherwise agreed, website design services require a 50% advance before commencement, 30% after development, and the remaining 20% upon project completion, before site upload or material release. Source files (e.g., PSDs) are not included unless quoted separately.
All payments must be made via bank transfer or cheque; account details are provided on invoices.
- Project Development Process
Data Entry: Entry of content/data by Webcrafts is separately billable unless specified in the contract.
Training: Two complimentary one-hour training sessions will be provided for projects with admin panels or CMS.
Technical Support: Support is generally complimentary unless the issue is due to third-party errors or extensive support is required, in which case our standard hourly rate applies.
- Client Review, Approval, and Rejection
Upon completion, clients are notified and given 7 days for written feedback. Absence of feedback is deemed approval. Once approved, work is considered accepted and balance payment becomes due. Unreasonable rejection of completed work allows Webcrafts to terminate the contract and seek payment for work done. - Project Timeline and Content
Webcrafts strives to launch sites per proposal timelines (default: two weeks after advance payment unless otherwise discussed). Clients must promptly provide necessary content (text, images) upon request. Delays beyond 2 weeks may incur a revision fee; delays over 3 weeks may result in project termination and billing for completed portions. - Payment Terms
Final payment is required regardless of receipt of all content. Outstanding content will be posted at no extra charge within 2 months of project completion. Further updates may be billable.
Projects may be cancelled within 3 days of signing. A refund, if applicable, will be processed within 10 days. Payment is due within 15 days of invoice receipt; late payments may be subject to interest and service charges.
- Default and Termination
Down payments and ongoing installments are non-refundable. In case of default or cancellation, payments made are retained by Webcrafts; the client will be billed for additional completed work. Repeated late payments, returned cheques, or non-payment are grounds to suspend or terminate services and to pursue legal or collection costs at the client’s expense. - Copyright, Intellectual Property & Design Credits
The client retains copyright to supplied materials.
Webcrafts retains copyright over any code, design, or assets it creates, except for client-logo-derived elements or explicitly signed-over work.
Clients get a license to use designs and code for the associated website and online presence, but do not own code or design for commercial reuse without permission.
Webcrafts may use a discreet “Website designed by Webcrafts” link unless the site’s design is altered significantly by others.
Use or redistribution of code/design beyond agreed scope requires Webcrafts’ approval and may attract extra charges.
- Media and Content Delivery
Clients must supply text and images in widely used digital formats unless agreed otherwise. Webcrafts will insert content as specified in the contract; additional data entry is billable. Changes in business direction requiring design/content alterations may incur further costs. - Server Access & Post-Launch Changes
For third-party server deployments, clients must supply temporary FTP and directory access. Webcrafts is not liable for changes/alterations made by the client or third parties post-deployment. Resolution of such issues may be billable. - Third-Party Integrations
Webcrafts integrates third-party tools/services (e.g., payment gateways) as agreed. Responsibility is limited to initial integration; later issues due to third-party changes are chargeable for resolution. - Subcontracting and Confidentiality
Webcrafts may subcontract portions of your project while maintaining confidentiality. Webcrafts and subcontractors agree not to disclose your confidential information. - Additional Expenses
Clients are responsible for reimbursing costs for domain registration, hosting, stock images, fonts, premium plugins, or any requests outside the original proposal. - Data Backups
Clients are responsible for maintaining their own site and data backups. Webcrafts is not liable for data loss except where caused by its own negligence. - Domains, Hosting & Credentials
Webcrafts will provide credentials for domains/hosting purchased on the client’s behalf once the client has reimbursed associated expenses. Renewal of domains is the client’s responsibility. - General
These Terms supersede all prior agreements. Acceptance is indicated by signature, advance payment, or online agreement. - Governing Law
This contract is governed by Indian Law, under Mumbai jurisdiction. - Limitation of Liability
Webcrafts is not liable for loss or damages related to errors, omissions, delays, or use of its services. Total liability under any claim is limited to the fees paid by the client for the relevant service. - Severability
If any part of these Terms is found unlawful or unenforceable, the remaining provisions remain valid and enforceable.
